Bulgaria has one of the most liberal foreign investment laws in the region regarding Bulgarian real estate as well as foreign investors. According to the Bulgarian Constitution and legislation foreign persons and companies can invest in real estate in Bulgaria either personally or through a local legal entity. Foreigners as persons can acquire only buildings but not land. Only Bulgarian citizens and legal persons (including such with a foreign owner) can obtain ownership of Bulgarian land.
Therefore, the most popular ways for becoming real estate owners are as follows:
• As far as houses, villas, flats and limited ownership rights (the right of use, the right to build a house, etc.) are concerned, you can directly purchase them as a person.
• When talking about Bulgarian real estate with land, one must set up a company that will be the owner of the property. Setting up a company in Bulgaria is very easy. Sofia view will help you throughout the all procedure, but if you want you can get a solicitor or barrister at law.

The registration of a company in Bulgaria is now offered at a lower price of 350 Euros , due to the cheaper company formation because of the new system of the online Trade Register.

Why need to form a company?
If you are a foreign person, you are still not allowed by the Bulgarian Law to own as a physical person a property which comes with land. Properties that come with land are: houses with gardens, plots and in some cases, apartments which go together with ideal parts of the land the block was built on. The only way to buy a property with land in Bulgaria is by forming a Bulgarian limited company. This is a smooth a straight-forward procedure, which has been used by thousands of foreigners so far.

The company you register will own the property and you will own the company and its assets. There is no need to have a Bulgarian partner or manager of the company – any foreign person can register and own 100% of the shares of a Bulgarian company. Will foreigners be allowed to own land as physical persons and when?
EU physical and legal persons will be allowed to own land in Bulgaria in the coming few years. After Bulgaria joined the EU in January 2007, the Treaty of Accession of Bulgaria to the EU allows Bulgaria to keep the prohibition for EU physical and legal persons to buy land in Bulgaria, for up to 5 years for land and up to 7 years for forests, and agricultural land after its accession to the EU. So, it will take a few years more for EU countries’ citizens to be allowed to own land in Bulgaria and in the meantime they can do this by registering Bulgarian companies.

For citizens of countries, which are not EU members, things will probably remain the same as now and they will need to register companies in order to buy land in Bulgaria.

Notary costs and fees, title deed – 3.5 % - 4.5% on the price of the deal (maximum 3 000 Euros)

Local taxes and fees – 2% - 3% on the value of the deal (depends on location)

Registration of the property in the Bulgarian administrations - 150 Euros

N.B. The process of the purchase starts with 15% deposit and payment of the price for the creation of the Ltd. company (if the buyer doesn’t already have an established Ltd company)
